Como las buenas noticias son escasas en la materia, informaros que el 16 de mayo se ha publicado la sentencia

Añadir la relevancia de la sentencia, ya que se elimina un precedente muy negativo (prohibición y vedas exclusivas
a los pescasub sin tan siquiera hacer una Reserva o Parque Natural) de cara a otras zonas marítimas...
PROYECTO DE RESERVA MARINA DE PALAMOS: tenemos información que apunta hacia la consideración de
"PROYECTO ARCHIVADO" por parte del ministerio. Creo que es positivo y me de valorar todos los esfuerzos de mucha
gente al respecto, manifestaciones incluidas.

Cabe destacar que el primer pleito se inicio con adecasub en el año 2009, que al final quedo paralizado y archivado
ha sido necesaria el empujo de la federación Española para que se lleve acabo este abuso.

Adecasub, siguiendo el mandato de sus estatutos, refrendado por sus socios en asamblea general del 2008, a interpuesto
su primer pleito en defensa de nuestra actividad.
El motivo principal es la actual regulación de la pesca submarina en aguas de formentera, la cual impone severas restricciones,
llegando prácticamente a su prohibición total.
Se autorizan 20 licencias, se prohíbe la pesca a mas de 20 mts de profundidad, se acotan zonas exclusivamente prohibiendo
la pesca submarina, pero no otras artes extractivas tanto profesionales, como recreativas de superficie, se habilitan días hábiles,
prohibiendo evidentemente los que no están habilitados, toda esta serie de medidas prácticamente suponen una casi prohibición
total de la actividad en toda la isla de formentera
. Esta asociación en vista de que nuestra actividad es la única afectada por esta norma, la cual consideramos totalmente
desproporcionada, no ha tenido otra opción que acudir a los tribunales de justicia, recurriendo la misma por la vía de lo
contencioso administrativo.
La contratación de un abogado especialista en derecho administrativo, y la interposición de la correspondiente demanda,
ante la sala de lo contencioso del tribunal Superior de Justicia de las Islas Baleares, se formalizo el 25 de Mayo del 2009.
Consideramos que la Vía Judicial es la única posible para defender nuestros derechos como pescadores recreativos y ciudadanos
de derecho. Un saludo.
