Está situado en el interior del Parque Maestro Antuña, entre las calles Covadonga, Pedro Braña y Avda. Fernández Ladreda, muy próximo al Teatro Prendes.
Recuerda el original Pleito contra los Delfines y calderones, que protagonizaron los marineros de Candás, en el 1616, ya que esas especies comían la pesca
destrozaban las redes, lo que molestaba a los pescadores. Por tal motivo, los pescadores pusieron una demanda y tras la celebración de un juicio, el pleito
fue ganado por los Candasinos.
El famoso pleito de “Los Delfines”, que cita el Señor Posada, ha sido como sigue, según cuenta el Señor González Dávila: “ El año 1616 se querellaron los pescadores
de los puertos y playas más vecinos de la ciudad de Oviedo, diciendo que los Delfines de aquellos mares les rompían las redes, con que les quitaban el sustento de
sus personas y casas; el que puso la demanda fue el licenciado Andrés García Valdés, cura de la Villa de Candás, el Obispo, que era don Martín Manso, hijo de Oñate,
en el Obispado de Calahorra, mandó que se diesen las censuras contra ellos, nombrado por abogado al doctor don Juan García Arias de Viñuelas, y contra ellos al
doctor don Martín Vázquez, catedrático de prima de Cánones en la Universidad de Oviedo y que se las intimasen en mar alta; así se hizo, y entrando en un barco
acompañado de un notario y de los que habían de ser testigos de todo, el muy reverendo padre Maestro Fray Jacinto de Tineo, de la Orden de Santo Domingo
catedrático de la Universidad de Oviedo, mando al notario, en virtud de las veces que llevaba el Obispo, leyese las censuras en voz alta, notificándoles a los
Delfines y mandándoles se apartasen de aquellos mares y no volviesen a ellos; y desde aquel día hasta los nuestros no se han visto en puertos, playas ni costas”.
Hechos Reales, por eso se hizo este monumento, archivos y crónicas guardados en el ayuntamiento de Candás .
