My hopes are that it will only limit tidepooling during low tides, hopefully we can argue that we disturb no intertidal/subtidal habitats when we are swimming out to our areas.

The Laguna Eco freaks win yet another...... gotta say they've done a great job of selling there program.... the quote from NOAA
"NOAA's Fisheries Service excluded the area of rocky habitat from Corona Del Mar State Beach to Dana Point from the designation, because the economic benefits of exclusion outweigh the benefits of inclusion, and the exclusion will not result in the extinction of the species. It was also determined that San Clemente Island and San Nicolas Island were no longer eligible for designation due to the development of integrated natural resources management plans that provide benefits to black abalone."Much / most of this area is MPA with about 7 miles completely closed to fishing..... but.... We're going to allow millions to trample the tide pools for (possible) economic benefit"......
This while the FGC will cause great econmic harm to the fishing industry by closing areas instead of proper management.

I'm afraid I don't understand why everyone is so up in arms about this. Did you happen to read this part?:
"Once areas are designated as critical habitat, federal projects or permits and projects with federal funding are required to ensure their actions do not adversely modify the animal's habitat. Designating critical habitat does not affect citizens engaged in activities on private land that do not involve a federal agency. "

I suspect people are still emotional from the MLPA fiasco and see this as another assault on fishing? If black abs are found around PV the feds may force the state to take action to prevent human interference in the form of closures.

Well if they ban interference of the intertidal zone they better ban EVERYONE and not just consumptives. Surfers, SCUBA divers, kayakers and tidepool observers should be banned along with us.
However, the main cause of Death stated in the article is from disease caused by pollution, so why no have Laguna finally deal with their pollution problems.

Well I think there is quite a big corolation between why there is hardly any kelp or sea grass from Victoria beach down to Table Rock and Aliso Creek run-off and pollution. I also don't see many abalone in that area either. All the abs i see are from Moss to Cresent bay.

I would be more worried about the species if I didn't see half a dozen ever time I climb out on the rocks in big sur. Granted, big sur is the heart of their range, but even so, it shows that at least the species isn't on the verge of disappearing...
