Capturing law breakers on video

  • Dan---
    1. My friend headhunter561 that was run over by a speed boat and got both his legs cut off by the props has the WHOLE incident on video filmed by a girl on headhunter561s boat :@
    2. Having a video of that boat that almost hit u in the water could have been helpful.
    3. Having a video of the boat that almost hit scott AND sdeisen could have been helpful.
    etc

  • I'd concentrate on taking evasive or preventative action instead of filming an imminent accident. Having a video of an "almost" accident IMO wouldn't be helpful in any way. What would you do with such footage?

  • Dan is correct. If I am the one that is in imminent danger I AM NOT going to be filming :(
BUT, if I have the oppertunity to video a boat screaming by us within 300f (1 football field) the video will be rolling and sent to where it needs to go for effect :angry5:
Having one spearo friend barely survive a speeding boat hit and losing both his legs at 26yrs old has polorized my attitude about speeding boats within my spearin zone
This week a CG boat hit a small pleasure boat, injuring 6 people and killing an 8yr old child:angry5:

    I copied/pasted this from Florida Statues;

    For Boaters in Florida
The following is from Chapter 27 of the 2003 Florida Statutes:
    (6) Any vessel other than a law enforcement or rescue vessel that approaches within 100 feet of a divers-down flag on a river, inlet, or navigation channel, or within 300 feet of a divers-down flag on waters other than a river, inlet, or navigation channel, must proceed no faster than is necessary to maintain headway and steerageway.
    (8) Except as provided in s. 327.33, any violation of this section shall be a noncriminal infraction punishable as provided in s. 327.73.
    1. For a first offense, $50.
    2. For a second offense occurring within 12 months after a prior conviction, $250.
    3. For a third offense occurring within 36 months after a prior conviction, $500.
    4. For a fourth or subsequent offense occurring within 72 months after a prior conviction, $1,000.

Where or to whom exactly are you going to send it? How will you send it? What do you think will happen if you do find a willing recipient?

  • i think your delving too deep into this questionn.. noones setting out to round up careless boaters but i do recognize that having a running camera going couold be useful. i understand what your saying dan that its silly to think u could say hey hey marine ppatrol look at this video of a boat going by me too close. on the other hand though what if someone ur diving with actually does get hit. ive read two articles jsut this year of boat hit and runs locally (in florida at least). and others from the past. also what if a boat gets snagged in your gear, tears up ur float and flloatline or wrecks up our kayaks and then decides to take off while we are jsut bobbing in the water like wtf? its a stretch to say a videos enough to matter about a boat wizzing by but in some circumstances itd be the peice of info ud really want to have. a lot of times boats have big names and graphics on the side like reel master or wahoo slayer or whatever goofy thing they slap on there.

  • here we go....basically the issue with the boating violation is that you need a law enforcement officer to witness it or it is one person's word against another...if you have evidence then there is support for the charges that are brought against the perpetrator

as far as who you can call, there are several options. you can contact the county or city's police dept and ask for the marine partol and tell them you were involved or you were a witness to the event.
they should have you file a report. If they don't, ask for their name and contact that counties state atty and tell then you were the victim or witness to the crime and tell them the statute...I would also mention the name and dept of the officer who refused to help you.

there is still no guarantee that anything will be done, but that would get it started.

  • basically the issue with the boating violation is that you need a law enforcement officer to witness it or it is one person's word against another

This is how I understood it and why I thought a vid wouldn't be any kind of guarantee, more so a waste of time that could detract you from concentrating on taking evasive or preventative action. However the topic has come up a few times already so I wanted to run it through the mythbuster. I actually have less interest in this issue than others seem to have, but if anyone wants to pursue finding out how to submit a vid to the authorities and whether it will make a difference, they can use this thread as a starting point.

You can call *FWC on your cell phone to get all the necessary info/report violators. You'll need the FL #'s of the boat and a clear shot of who is/was at the helm in the video.

Rob having the whole thing on the video( if it clearly depicts how close he came to 300ft of the dive flag, and his actions after the accident) will seal the deal. I have spoken to him but he didn't want to devulge too much as it is still an open case.
